No Occupancy Certificate for 30×40 & 40×60 Plots in Karnataka: Latest 2026 Update

The Karnataka government has introduced a major reform by relaxing Occupancy Certificate (OC) requirements for small residential buildings, offering significant relief to homeowners, particularly in Bengaluru. As per the latest rules, independent houses constructed on 30×40 plots (up to 1200 sq ft) are exempt from obtaining an OC, provided the building complies with approved plans and is within the permissible height limits, typically up to Ground + 2 floors or Stilt + 3 floors.

This decision addresses long-standing issues where thousands of completed homes were unable to secure basic utilities such as electricity and water due to delays in OC approvals. The move is aimed at simplifying processes, reducing bureaucratic bottlenecks, and supporting middle-class homeowners who form the majority of independent house builders in the state.

However, there is widespread confusion regarding 40×60 plots (2400 sq ft). Currently, these plots are not fully exempt from OC requirements. While some relaxations are being observed in practice—such as provisional utility connections or case-by-case approvals—the law does not yet provide a blanket exemption for larger plots. Property owners should therefore proceed with caution and ensure compliance with all applicable regulations.

It is important to note that OC exemption does not mean exemption from building rules. Homeowners must still obtain proper plan approvals, adhere to BBMP or local authority guidelines, and avoid unauthorized deviations. Non-compliance can lead to penalties and legal complications.

In summary, while 30×40 plot owners benefit from full OC exemption, 40×60 plots remain under partial relaxation. The policy signals a shift toward simplified governance but still requires careful adherence to construction norms.
